Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Calyura website and subscription services (together, the "Services"), operated by 3JAE Collective, doing business as Calyura ("Calyura," "we," "our," or "us"). By creating an account, subscribing, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and subscribe to the Services.

2. Description of Services

Calyura provides subscription access to NCLEX exam preparation content for two separate tracks — Registered Nursing (RN) and Practical/Vocational Nursing (PN/VN) — including an adaptive practice simulator specific to your track, a shared wellness and self-care app, and review-of-systems lesson content. Each track is a separate subscription; access is limited to the track you purchase.

3. Account Registration

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Accounts are for your individual, personal use only and may not be shared, sold, or transferred. Notify us immediately if you suspect unauthorized use of your account.

4. Subscription, Billing, and Cancellation

  • Subscriptions are billed monthly at the then-current price ($59.99/month per track at the time of writing) through our payment processor, Stripe, and renew automatically until canceled.
  • You may cancel your subscription at any time from your account. Cancellation stops future billing; you will retain access through the end of the billing period you already paid for.
  • Except where required by law or at our sole discretion, payments are non-refundable, including for partial billing periods.
  • We may change subscription pricing going forward; any change will apply to future billing cycles and will not retroactively change amounts already charged.

5. License to Use the Services

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal exam preparation. You may not copy, redistribute, resell, reverse engineer, or publicly share any course content, simulator questions, or other materials made available through the Services.

6. Educational Purpose — No Guarantee

Calyura's content is for educational and exam-preparation purposes only. It is not medical advice, nursing practice guidance, or a substitute for accredited nursing education or clinical instruction. Calyura does not guarantee that use of the Services will result in passing the NCLEX-RN, NCLEX-PN, or any other licensing exam, nor any particular academic or career outcome.

NCLEX-RN and NCLEX-PN are trademarks of the National Council of State Boards of Nursing, Inc. ("NCSBN"). Calyura is an independent exam-preparation provider and is not affiliated with, endorsed by, or sponsored by NCSBN.

7. Third-Party Services

The Services rely on third-party providers, including Stripe for payment processing and Lovable for our embedded simulator and wellness applications. Your use of those embedded tools is also subject to those providers' own terms, and we are not responsible for their availability or performance.

8. AI Wellness Assistant

The wellness app included with your subscription features a chat, mood-tracking, and journaling assistant built on third-party AI technology. It is designed to offer supportive, reflective conversation and self-care check-ins. It is not a licensed therapist, counselor, psychiatrist, or medical provider, does not diagnose or treat any mental health or medical condition, and is not a substitute for professional mental health care.

If you are experiencing a mental health crisis, having thoughts of self-harm, or need immediate help, contact 988 (the Suicide & Crisis Lifeline) or emergency services (911) directly. Do not rely on the assistant as your only resource in a crisis. While the assistant is designed to encourage you to seek help when it recognizes signs of significant distress, it is an automated tool, not a monitored safety system — no Calyura staff member reviews your conversations or is alerted in real time, and the assistant may not identify every situation that warrants outside support. You are responsible for reaching out for help when you need it. Calyura is not liable for the accuracy, completeness, or outcome of any response generated by the assistant.

9. Prohibited Conduct

  • Sharing your account or login credentials with anyone else.
  • Copying, scraping, screen-recording, or redistributing course or simulator content.
  • Attempting to interfere with, disrupt, or reverse engineer the Services.
  • Using the Services for any unlawful purpose.

We may suspend or terminate accounts that violate these Terms, without refund.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CALYURA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold Calyura harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Services.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Services shall be resolved in the state or federal courts located in California.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

15. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Calyura regarding the Services.
