How to Use This Lesson

Delegation only works if you know who is allowed to do what — and that is defined by scope of practice. Analogy: think of a driver’s license. A regular license lets you drive a car, but not a commercial truck or a motorcycle unless you hold that specific endorsement. Your nursing license works the same way: it defines exactly what you are legally permitted to do, and stepping outside those boundaries — even to help — is unsafe and can cost you your license. This lesson explains the boundaries and the rules that set them.

Definition

Scope of practice is the range of activities, procedures, and responsibilities that a nurse is legally authorized and competent to perform, based on their license, education, and the law in the state where they practice. It defines the boundaries of safe, legal nursing care for each role (RN, LPN/LVN, APRN, UAP).

Purpose (Why This Matters for the Nurse)

Practicing within scope protects patients (care is delivered by someone qualified to give it) and protects the nurse’s license (practicing outside scope is a legal and disciplinary violation). Knowing your scope also guides safe delegation — you can only delegate what falls within the delegatee’s scope, and you must decline tasks outside your own.

The Nurse Practice Act & State Boards of Nursing

The Nurse Practice Act (NPA) is the law in each state that defines nursing scope, sets licensure requirements, and describes grounds for disciplinary action. It is enforced by the State Board of Nursing (BON), which issues licenses, sets rules, and disciplines nurses who violate the act.

The NPA is state-specific — scope can differ slightly from state to state.
The Board of Nursing (not the employer or the physician) has final authority over scope.
A facility policy may be more restrictive than the NPA but never broader than the law allows.

Key hierarchy: the Nurse Practice Act sets the outer legal limit. Within that, facility policy and your demonstrated competence may narrow what you actually do — but nothing can expand your scope beyond the NPA.

What Determines Your Scope

Several layers combine to define what you may safely and legally do:

The Nurse Practice Act and Board of Nursing rules (the legal limit).
Your license level and education (RN, LPN/LVN, APRN).
Certification and demonstrated competence for specific skills.
Facility policies and job description.
Professional standards (ANA Standards of Practice) and evidence-based guidelines.

Scope by Role

RN	Full nursing process — assessment, planning, teaching, evaluation, nursing judgment; care of unstable patients; delegation and supervision.
LPN/LVN	Works under the RN; data collection and care for stable patients; most medications (not IV push per policy); reinforces teaching.
UAP / AP (CNA)	Unlicensed — basic ADLs, hygiene, feeding stable patients, routine vitals, I&O, ambulation; no assessment, teaching, or judgment.

Standards of Practice vs. Standards of Care

Standards of Practice (from the ANA) describe the competent level of nursing care expected — built on the nursing process (assess, diagnose, plan, implement, evaluate).
Standards of Care are the legal yardstick: what a reasonably prudent nurse with similar education and experience would do in the same situation. They are used to judge negligence/malpractice.

Why it matters: if a nurse’s care falls below the standard of care and the patient is harmed, it may constitute negligence or malpractice. Staying within scope and meeting the standard of care protects both patient and nurse.

Licensure and the Nurse Licensure Compact

A nurse must hold a valid, current license in the state of practice. The Nurse Licensure Compact (NLC) allows nurses in member states to hold one multistate license and practice in other compact states, but the nurse must follow the Nurse Practice Act of the state where the patient is located. Licenses require periodic renewal and continuing education.

Working Within Your Scope (Decision-Making)

Before performing or accepting a task, ask:

Is this task within my Nurse Practice Act and Board of Nursing rules?
Is it allowed by my facility policy and job description?
Am I educated and competent to do it safely?
Does it meet the standard of care?

If any answer is no, the task is outside your scope — do not perform it.

When Asked to Work Outside Your Scope

If a provider, manager, or coworker asks you to perform a task outside your scope or competence, you should decline the task and notify your supervisor. “A physician ordered it” does not make an out-of-scope task legal, and you remain personally accountable for anything you perform. Never carry out an order you know to be unsafe, incorrect, or outside your scope — clarify or refuse and escalate.

⚠ Rule: you are legally responsible for your own actions. Performing a task outside your scope — even under orders — can result in patient harm and loss of your license.

Recognize cues — the task, the role/license involved, and the patient’s stability.
Analyze cues — is the task within the person’s legal scope and competence?
Prioritize hypotheses — patient safety and legal boundaries first.
Generate solutions — perform it, delegate it appropriately, or decline and escalate.
Take action — act within scope; refuse out-of-scope tasks.
Evaluate outcomes — confirm safe, appropriate care was delivered.

Reasoning frame: “Is this within my license, my competence, and the standard of care?” If not, don’t do it — an order or a busy shift never expands your scope.
